Abstract
Comments on the Law Commission's proposal in its 2016 report "Consumer Prepayments on Retailer Insolvency" that prepaying consumers should be given preferential status in retail insolvencies, including: its rationale; its cost impact on the insolvency; the validity of trusts created for consumers in the "twilight period"; and the wider concern that the prescribed part cannot guarantee unsecured creditor realisations in insolvency.
