Abstract

Considers the concept of restorative justice in transitional contexts. Looks at the legal interpretation of both restorative and transitional justice and their relationship with human rights law. Identifies and assesses three interactions between restorative and transitional justice: (1) attempts to reckon with the criminal acts of a prior regime; (2) human rights and restorative justice within domestic criminal justice reform in states emerging from a period of totalitarianism or conflict; and (3) the interaction between restorative justice and classic transitional justice policies.
