Markets in Grid services are now possible due to Grid middleware providing a service-oriented architecture. However, service providers and their consumers must agree to mutual obligations for service usage through the formation of a contract. As Grid services will be offered across national and juridical boundaries how, where and when the contract is formed is of interest to the Grid community as this has an impact on the design of a contract formation protocol. This paper examines how existing EU regulation, frameworks and directives can be used to specify the requirements for a EU contract formation protocol and how this affects current work such as WS-Agreement.
