This paper has three main goals. First, it briefly draws together the detailed legal commentaries on the four principles contained in Chapter IV of the Declaration on European Digital Rights and Principles for the Digital Decade (‘the Declaration’) provided by experts in digital and media law. Second, it considers some of the implications of the constitutionalisation and the affirmation of human rights commitments in this digital space, particularly how they relate to the defence of representative democracy. Finally, it proposes how legal design methods and mindsets could be deployed to enhance the efficacy of regulation and the experience of citizens in enjoying their rights of participation in the digital space.
