The legislation that contextualises corporate rescue is contained within para.3 of Sch.B1 to the Insolvency Act 1986, which sanctions both company rescue and business rescue, as the primary and secondary objectives respectively. The differences in approach have been allowed to co-exist since they serve different purposes and produce different outcomes. This article will take a look at the objectives set out in para.3 and in particular examine whether the focus should be on company or business rescue.
